***Below are the general terms under which we, New England Biolabs, Inc.® (NEB®) provide our products to you, and they will govern all your free product orders from NEB. Our provision of these products at no cost is expressly conditioned upon your acceptance of these terms, and you will be deemed to have accepted these terms unless you return the products you received to us unopened and unused no later than 10 days after your receipt.
The products we are supplying to you are for teaching purposes and research use only and are not for any commercial use, or for human or animal therapeutic or diagnostic use. You are solely responsible for making sure that the way you use the products complies with applicable laws, regulations and governmental policies, third party intellectual property rights, and for obtaining all necessary approvals and permissions that you may need related to your use. It is solely your responsibility to make sure the products are suitable for your particular use, that they are used according to established safety procedures and it is your responsibility to conduct any research necessary to learn the hazards involved for any of your uses of products we are supplying to you. You also have the duty to warn your students, employees, and any auxiliary personnel of any risks involved in using or handling the products. You agree to comply with instructions for use of the products furnished by us, if any, and not to misuse the products. You acknowledge that we provide Safety Data Sheets (SDSs) for our products, and that they are available electronically on our web site at www.neb.com, or in paper copy by contacting NEB at 1-800-632-7799, and that you are willing and able to access SDSs by these means. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. We will not be held liable for any damages, claims or suits resulting from the use, storage, handling, contact disposal or transfer of the products.

Except as specifically stated above, your purchase, acceptance, and/or payment of and for NEB’s products is pursuant to NEB’s Terms of Sale at www.neb.com/support/terms-of-sale. NEB does not agree to and is not bound by any other terms or conditions, unless those terms and conditions have been expressly agreed to in writing by a duly authorized officer of NEB.
